GENERAL CONDITIONS OF USE OF THE SITE

Preamble :

The purpose of these general terms and conditions of use of the Site (hereinafter the “Terms and Conditions”), published by SERAD SAS (hereinafter “SERAD”) is to set forth the terms and conditions of use of the Site.

Any person having access to the Site and the services offered, in any capacity whatsoever, the place where it is located, the terms of connection, the object and purpose of its access, is a user (hereinafter “the User”).

The User is presumed to know and accept, without reservation, the Terms and Conditions of Use in their latest version by the sole fact of his connection and consultation to the Site. SERAD may update the TCU, without prior notice and information. The User is therefore advised to regularly refer to the latest version of the TCU.

PURPOSE OF THE SITE

The purpose of the Site is to present :

  • The products and services provided by SERAD and its subsidiaries
  • Its distributors
  • Information of any kind.

PERSONAL DATA

Consultation of the Site is possible without the User having to reveal his/her identity or any other personal information concerning him/her.

However, the User may use the services of the Web Site to contact SERAD or one of its subsidiaries or distributors directly. In this case, and in order to respond to the User’s request (purpose of the processing), the data relating to the User’s identity and location (filled in the appropriate fields) and possibly its geolocation will be processed by SERAD. These data will be kept for the duration of the execution of the request, and at the latest for six months from the date of the request.

The recipients of such personal data are the distributors or the subsidiary of SERAD identified and able to respond directly to User.

The legal basis of this processing is the consent of the User, previously informed, before sending the request.

In accordance with the French Data Protection Act No. 78-17 of January 6, 1978 as amended and in accordance with Regulation 2016/679 of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and the free circulation of such data, User may exercise its rights of access, opposition, rectification and portability to data concerning it by sending its request to request@serad.fr. The User may consult the cnil.fr site for more information or to make a claim on his rights.

SITE CONTENT

On the Web Site, SERAD makes available to Users information relating to its products and services on an indicative and non-exhaustive basis.

Thus, the photos and explanatory texts are not intended to specify the characteristics of each product and service. It is for this reason that SERAD makes available the information necessary to directly contact its commercial network, which are able to advise and inform. The information disseminated on the Site will be regularly updated.

ACCESS TO THE SITE – USE – SECURITY

The User can connect and visit the Site without a login. Only an internet connection is required.

The User acknowledges that he or she is appropriately equipped, particularly in terms of computing, telecommunications and security, to access and use this Site. All costs and fees for equipment, communications, telecommunications and other costs necessary for the connection and use of the Site, as well as any necessary authorization related thereto, are the responsibility of the User.

While SERAD makes every effort to ensure that the Site is accessible 24 hours a day, 7 days a week, it is possible that in the context of testing, maintenance, updating, interventions in the event of breakdowns, the Site may be inaccessible and/or incomplete. Also, SERAD reserves the right to close or make inaccessible all or part of the Site.

The User undertakes not to disrupt the operation of the Site and not to use the communication services in an untimely manner. User agrees to use the Site or its content in accordance with national and international regulations and in a manner that does not damage SERAD’s reputation.

SERAD implements the appropriate technical and organizational measures, according to the rules of art, to protect the data against accidental or unlawful destruction, accidental loss, alteration, dissemination or unauthorized access.

RESPONSIBILITY

SERAD makes no warranty as to the accuracy, precision, updating of the information on the Site.

Neither SERAD nor any of its subsidiaries or affiliates shall be responsible for the interpretation, completeness, accuracy, adequacy or timeliness of the data and information contained in the Web Site.

In no event shall SERAD or any of its affiliates be liable for any damages of any kind arising directly or indirectly from the use of the Web Site, including, without limitation, any viruses that may damage or render unusable User’s computer equipment.

The User hereby waives any recourse against SERAD for any damages of any nature whatsoever such as, and without this list being exhaustive, loss of data, programs or files, financial loss, damage to computer equipment (including, without limitation, connections, software, hardware), viruses that may appear as a result of access, use or unavailability of the Site, recourse relating to the rights and licenses required for the use of and access to the Site.

INTELLECTUAL PROPERTY

The Site and its content, including the databases composing all or part of the Site, are the property of SERAD or are subject to an authorization of use, both with respect to its general design and to the software, graphics, databases, design, photographs and images, texts, drawings, sounds, and all other works that constitute the content of the Site.

The User undertakes to strictly respect these intellectual property rights.

Any representation or reproduction, in whole or in part, of the Site, whether in return for payment or free of charge, without the prior written authorization of SERAD of the author and the publisher or of his successors or assigns is prohibited, except for the strict needs of online consultation.

Any reproduction, use, imitation, affixing, deletion or modification of these elements without the prior written authorization of SERAD or one of its subsidiaries is prohibited and constitutes an act of infringement punishable by law.

HYPERTEXT LINKS

The Site is likely to contain hypertext links with other sites (“third party sites”). SERAD has no control over these Third Party Sites, which are independently administered by their operators. Consequently, SERAD shall not be liable in any manner whatsoever for any harmful consequences to the User of access to a Third Party Site following the activation of a hyperlink on the Site.
